Terms of Service

These Terms ("Terms") govern your access to and use of Project Gains (the "Service"). By creating an account or using the Service you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. By using it, you confirm you meet that requirement.

2. Not medical or fitness advice

Project Gains is a software tool — not a replacement for a doctor, physical therapist, certified trainer, or other licensed professional. AI-generated suggestions (program critique, plateau diagnosis, form check, weekly debriefs, etc.) are heuristic outputs that can be wrong. Use your own judgment, and consult a qualified professional before changing your training, nutrition, or rehab plan. You assume all risk for activities undertaken based on anything you read in the Service.

3. Your account

You're responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at support@projectgains.app if you suspect unauthorized access.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to bypass our rate limits, quotas, or other security controls.
  • Resell, sublicense, or repackage the Service.
  • Upload content you don't own or have permission to share (this includes form-check photos that include other people without their consent).
  • Scrape, harvest, or reverse-engineer any part of the Service.
  • Submit content that's abusive, harassing, hateful, or otherwise violates our community standards.

4.1 Community standards and reporting

We operate a zero-tolerance policy for objectionable content and abusive behavior on the social, comments, and profile surfaces. Prohibited content includes (but is not limited to) harassment, hate speech, sexual or graphic content, content promoting eating disorders or self-harm, impersonation, and spam.

Every post, comment, and profile has a Report menu item. Reports are reviewed by our moderation team within 24 hours, and we may remove content, warn users, suspend accounts, or terminate accounts for violations. You can also block any user from their profile or any of their posts; blocked accounts can no longer see your content, follow you, comment, or react. Manage your block list from Settings → Blocked accounts. Report-related questions can be sent to support@projectgains.app.

5. Your content

You retain ownership of the content you submit (workouts, routines, notes, photos, etc.). By uploading content you grant us a limited license to store, process, and display it in connection with operating the Service. When you make a piece of content public (e.g., publishing a routine to the marketplace), you grant the public a license to view and clone it according to the Service's documented behavior.

6. Subscriptions and billing

  • Free, Standard, and Premium tiers are offered. Feature availability is documented in the app.
  • Paid subscriptions renew automatically until cancelled. Cancel anytime from Settings → Billing — your access continues through the end of the current billing period.
  • We may change pricing with 30 days' notice. Existing subscribers stay on their current price through the end of the term.
  • Refunds are at our discretion outside any statutory consumer protections in your jurisdiction.

7. AI features

AI-powered features are subject to monthly quotas based on your tier. Quotas reset on the first of each calendar month. AI outputs are heuristic — verify before acting on them. We may adjust quotas and providers over time.

8. Termination

You may close your account anytime by contacting support@projectgains.app. We may suspend or terminate accounts that violate these Terms. Sections about your content, disclaimers, and limitations of liability survive termination.

9. Warranty disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER Project Gains NOR ITS AFFILIATES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $50.

11. Changes to these Terms

We may update these Terms. Material changes will be announced via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
